A US federal appeals court cleared the way for the execution of the only woman on death row before President-elect Joe Biden takes office

The ruling passed on Friday by a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit concluded that a lower court judge made a mistake when he was in last week an order had cleared the date of execution of Lisa Montgomery

District Court Judge Randolph Moss had ruled that the Department of Justice should order Montgomery’s execution on May 12 January had illegally postponed and he cleared an order from the director of the Bureau of Prisons

Montgomery was convicted of the murder of 23-year-old Bobbie Jo Stinnett in December 2004 in the northwest town of Skidmore, Missouri

She strangled Stinnett, who was eight months pregnant, with a rope and cut the girl out of Stinnett’s body with a kitchen knife, the authorities said

Montgomery took the child and tried to pass the girl off as her own, according to prosecutors

If her execution is carried out, she would be the first woman to be executed at the federal level since 1953

Mr Biden is against the death penalty and its spokesman, TJ Ducklo, has said he will work to end its use

But Mr.Biden did not say whether he would like the federal executions after taking office on Jan. January will set

President Donald Trump’s administration has postponed 13 executions since July, when Republicans resumed federal executions after a 17-year hiatus

Ten of them have already been killed and two more are planned before he leaves office
