BIRMINGHAM, Ala – An atheist group urged a judge Wednesday to end the federal lawsuit against the state of Alabama because officials revised their voter registration forms, requiring an oath to God

The Freedom From Religion Foundation and the Office of Secretary of State John Merrill jointly petitioned a court to dismiss the case filed last year for a required oath for prospective voters to read “Help me God show court documents.” / p>

The updated form still contains the wording, but it also includes a field where registrants can decline the religious portion of the oath “because they sincerely believe in it” Applicants must continue to “swear or affirm” requirements, including that they are a US Citizen; be eligible to vote; and not affiliated with groups advocating overthrowing the government

The Wisconsin-based foundation filed lawsuits on behalf of four atheists who argued the oath was a religious requirement that violated their constitutional rights. One of the plaintiffs, Randall Cragun, said he refused to take the oath to register for a vote in the state, but can do so now

“It is disappointing that the state prevented me from voting in the 2020 elections, but I look forward to participating in the future and I now have a better understanding of the worth of my voice and other individual voices State contribute to shaping the elections, “said Cragun in a statement

Two other people who have sued, spouses Chris Nelson and Heather Coleman, signed up in March to vote on the new form, the foundation said in a statement

Neither Merrill’s office nor Gov Kay Ivey’s office responded to emails asking for comment on the settlement

The Foundation and the Republican-controlled state have agreed to pay their own costs in the lawsuit, according to the dismissal petition
