Wilmington, Delaware: Former Hollywood producer Harvey Weinstein on Monday asked a New York State appeals court to overturn his sexual assault and rape conviction and allow a new trial The trial judge committed several mistakes that an impartial jury refused to accept

Weinstein, 69, was sentenced to 23 years in prison by Judge James Burke of the Manhattan Criminal Court in March 2020 for assaulting former production assistant Mimi Haleyi and raping former aspiring actress Jessica Mann

His belief was seen as a turning point in the #MeToo movement against sexual abuse and harassment

Weinstein makes seven arguments in an effort to break his conviction by setting a jury whom Weinstein’s lawyers accused of being grossly unqualified in an overly harsh judgment

His lawyers also argue that he was denied a presumption of innocence when Burke allowed the jury to hear testimony from three women who claimed Weinstein attacked them despite their allegations not leading to criminal charges

The three women described for the jury what prosecutors characterized as Weinstein’s characteristic pattern of behavior: luring women into hotel rooms or his apartment to discuss film roles and then attacking them

Weinstein’s lawyers had asked Burke during the trial to exclude two of the three from testifying

The jury was instructed that the testimony of the three women could only be used as evidence of Weinstein’s intent and not as a propensity for sexual assault

Weinstein said the third degree rape charge should be dismissed because the alleged wrongdoing occurred too long ago and a new trial should be for a single count of first degree criminal sexual acts

Even if his conviction has been overturned, Weinstein faces charges in Los Angeles, among other things, of rape of five alleged victims from 2004 to 2013. Weinstein faces a prison sentence of up to 140 years if convicted in the case
